Mehlville Fire District Willfully Violates the Law

To: Mehlville Fire Protection Board of Directors, Chief Silvernail, and Carla Juelfs (Records Custodian)
During the last year I have informed, instructed and pleaded with the district to comply with Missouri's open Records laws.
Last week, I clarified with your attorney your violations. This week, your records custodian confirmed your lack of compliance.
As of this morning, you are still in violation of not posting your meetings at the district firehouses. This can be accomplished by simply taping a copy of your meeting dates and times on the glass doors of the firehouses just as you do at the district's headquarters. This should have been accomplished 241 days ago.
The BOD has a meeting tonight with a tax rate hearing. It has not been posted as required by law. It's not posted on your website. The date is but there is nothing to indicate it is a tax rate hearing.
I have also requested to be notified as media about meetings as required by Missouri Sunshine Law. This has not happened either as I have been removed from your media notification list for expressing my opinions about the district.
At this point, I can only assume by your actions that the BOD, the chief and the records custodian desire to willfully violate these laws.

Mikr I know your not going to believe it but The firehouse that I live by just posted three form by the front door. Does this mean that they are admitting they were wrong on the laws or were they just being nice to you? Once again thank you for staying on top of them and at least doing your part to attempt to keep them within the laws. You know the real ones and not just the ones they decide to follow. Great work Mike!

If the infractions against the Sunshine Law by MFPD bother you so much, why don't you sue them?

The Call sued Mehlville Schools for their violation of the Sunshine Law (while you were on the Board) and settled for a nice chunk of change. Maybe you'll get lucky.

Nobody on the BOD cares about your phony gripes anyway. You are nothing more than a buzzing gnat to the MFPD officials. I think they are perversely amused by your insanity.

My advice is to get a better lawyer the John "The Loser" Goffstein.

4;34 The Call posted the tax rate hearing for the wrong night in two different issues. They don't mind getting the story wrong.4;51 I just might. I would prefer to get them to comply with the law. The Call got the school board and their insurance company to settle after several years. They lost money on the lawsuit and never got the information they saught. They usually lose in court. I'll update you on their current case soon. Mr. Goffstein is a fine attorney. Your name calling is childish.

7:16 Perhaps you'd like to be more specific as to what you think I've said that was a rumor. And why do you like spreading rumors that I get my information from certain people. You seem to be a bit of a hypocrite. As to this particular post, these are all facts. If you don't believe me, you can call the Mehlville Fire Department and ask for Carla. She will tell you everything I've written is 100% accurate.

As a tax payer of the fire district, I am more concerned about lower taxes then posting of an agenda. I think it is silly to post at all fire stations the school district does not post the meeting agendas at all schools. The agendas and the other crap that you are talking about means very little to the tax payers. TAXES DO:

You might think it's silly, but it's the law. And it's just one of many that the Mehlville Fire Board violates. Taxes do matter and we have the right to know how the board is spending our money. The only reason I point out the numerous Sunshine Law violations is because the Call Newspapers pretends to care. They look the other way when the fire board violates these and many other laws. I seem to remember that the Truth Spot had something on their front page about being for open government. I'll bet they're silent when their buddies are breaking the law.

Be sides the agenda what laws have the fire department broken, I also want te statue number that the law falls under. Just because you don't like what they are doing does not mean the law is broken. IT SOUNDS LIKE CRYING TO ME.

Has anybody really looked at there tax bills for the last 3-4 years and seen the BIG taxe savings! HA I did and guess what. So Far I saved 42.00 from 2006. Enough for a night at the movies and maybe some hamburgers! It looks to me the fire board has lied to us and I hope they are happy at the destruction of our fire department!

1:09 No law requires such posting or school districts. You wouldn't need it anyway. The school districts post all their meetings far ahead of time and besides being at the admin office, they are in the papers and the district's website.
The statute has been clearly identified in my posts. MO Rev 321.200.

I'm not an attorney but several have been pointing out to judges and the BOD the specific statutes they have been violating over the last couple of weeks.

Mike - I commend your professionalism in dealing with reckless and immature comments posted by anonomous. Knowledge and information is powerful and effective. Most are uncomfortable hearing different perspectives and find it easiest to take the defensive rather than trying to figure out the issue. Reaction through uneducated rhetoric and bullying accomplishes nothing. Case in point, the MFPD BOD. It's interesting the amount of emotional energy put into following a website that poses different views just to post the unsubstantiated and useless comments. Imagine what could be accomplished if that energy was applied to gaining a level of cognative understanding. I see a genius in the making if only....
